The following terms and conditions will apply between you and Fig Cashmere for the purchase of any item. These terms do not affect your statutory rights.

Acceptance of Terms and Conditions

By ordering a product from us you accept our terms and conditions. These terms and conditions are subject to change at any time.

Orders

The products, descriptions, and prices shown on our website constitute an “invitation to treat”, consequently all orders are subject to acceptance and product availability.

Orders placed through our website, whether payment is made at the time of order or not, are subject to confirmation of acceptance by us. Up to the point of acceptance orders placed through our online ordering facility should not be interpreted as contractually binding on either party. Automated system acknowledgements of receipt of the order, confirmation of order, or receipt of payment, do not constitute acceptance of the order by us. Dispatch of your order at the prices shown on the website will in all cases constitute formal acceptance of the order by us in the absence of any other formal acceptance.

Our Contract

A legally binding contract between you and us will be formed when we dispatch your order. If your order is only partially dispatched, the contract will only apply to the goods dispatched. The products that have not been dispatched will not form part of our contract with you until they are dispatched.

Although we endeavour to ensure prices on our website are correct, we reserve the right to change prices without prior notice. In the event of any change e.g. in price or expected delivery date between completion of your order and dispatch, we shall inform you by e-mail and you shall at that point have the right to either (a) accept the change, in which case your reply will represent a new offer which we will accept upon dispatch, or (b) reject the change, in which case your reply will represent a withdrawal of your order, or the remaining part of your order.

Product Substitution

In the event of a product becoming unavailable, no alternative product will be substituted by us without your prior agreement. We shall inform you by e-mail of any suitable substitute product and you shall at that point have the right to either (a) accept the substitution, in which case your reply will represent a new offer which we will accept upon dispatch, or (b) reject the change, in which case your reply will represent a withdrawal of your order, or the remaining part of your order.

Delivery Times and Charges

We hold most of our products in stock which means they will be dispatched within 7 to 14 days of receipt of order.  If we do not have the item you have ordered in stock we will advise you of our estimated delivery time, which is unlikely to exceed 28 days from receipt of order as we manufacture all our products “in-house” in Nepal.

We will dispatch your order by Royal Mail according to the following charges:

Royal Mail (UK): Standard delivery at a cost of £4.95 per order (including VAT). Please allow 7 to 14 days days for delivery.
Royal Mail International (Europe): Delivery within Europe at a cost of £8 per order, (£8.00 including VAT for EU countries, £8.00 excluding VAT for non-EU countries) please allow 14-21 days for delivery.
Royal Mail International (Rest of World): Delivery anywhere else in the world by airmail at a cost of £15 per order (VAT not applicable), please allow 14-21 days for delivery.

VAT

VAT at the current rate is due on all purchases made by customers in the UK and the European Union (EU). VAT is not charged to customers from outside the EU. All prices on our site are shown including VAT by default where applicable. When non-EU shoppers register and are logged in to the site, prices are subsequently shown excluding VAT.

Payment

We accept debit or credit cards and cheques made payable to Fig Cashmere Ltd.

Payment may be made through our website, by post, or over the telephone.

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and we will not be liable for any delay or non-delivery.

Orders paid for by cheque will not be dispatched until we receive confirmation of cheque clearance.

Returns and Exchange Policy

We hope you will be pleased with your purchase but if for any reason you would like to return it for a full refund then please return the product to us within 14 days in the box and/or re-sealable package in which it arrived.  As long as the product is in an unworn and re-saleable condition we will refund the full cost excluding postage.  Please return products to the following address:

This returns policy does not affect your statutory right to cancel but is separate and additional to your statutory right.

Notice of Your Statutory Right to Cancel

You have the right to cancel the purchase of any item from the time it is ordered to within seven working days of delivery (starting the day after you receive the goods). This is a UK statutory right.

Should you exercise your statutory right to cancel the contract we will refund the price you have paid for the goods and standard delivery, but not an additional service provided by us, such as special packing or a special delivery service.

You are under a duty to take reasonable care of the goods, which means the goods must be unworn and undamaged. If the item is not in an “as new” condition and not in the same condition as delivered, this may affect your statutory right to cancel.

How to cancel

To cancel an order, please send a request to cancel the order in writing, by either e-mail or post, stating the reasons for your cancellation of the order or return.

Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error, or the item is faulty.  If we do not receive the goods back from you, we may arrange for collection of the item from you and charge our cost of collection to you.

After cancellation of the order, we will refund the relevant part of the purchase price for that item to you as soon as possible after the return of the goods, and within a maximum period of 30 days from cancellation.

Refunds will be made by the same method of payment as the original payment. Fig Cashmere will not be responsible for any delays arising through the banking system in the crediting of refunds to cardholder accounts. 

Warranty

Should there be a fault with the product we will replace it free of charge and refund the postage you incurred up to a maximum of £10.00. Wear and tear is not covered under this warranty.

Force majeure

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control.

Your undertakings and warranties

You warrant that the information given on your order form is complete and accurate.

Limitation of Liability

Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction.

Copyright in all content, materials, product or garment designs, text, and images contained in our website is protected, and may not be copied, reproduced or redistributed in any way without the written permission of the copyright owners.

Invalidity of Terms and Condition

If for any reason part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.

Governing Law and Jurisdiction

Contracts between you and Fig Cashmere shall be governed by English Law and you and Fig Cashmere submit to the exclusive jurisdiction of the English courts.
